I. Conclusion of contract

All offers by Airportparking (Switzerland) GmbH are non-binding and subject to change to the extent that they have not been expressly designated as binding. Submitting a reservation to Airportparking (Switzerland) GmbH shall constitute a binding offer for conclusion of a contract. The contract shall only come into force on a corresponding confirmation by Airportparking (Switzerland) GmbH, which generally occurs within 24 hours after the request for reservation. Where a third party has performed the reservation, same shall be liable, as joint debtor together with the customer, for all contractual obligations on the part of the customer. All claims from the contractual relationship shall be exclusively for the customer and may only be transferred to a third party with the consent of Airportparking (Switzerland) GmbH.

II. Scope of services
Airportparking (Switzerland) GmbH shall provide the customer a parking bay that is not guarded and not protected against the effects of the weather at the location of parking bays leased by Airportparking (Switzerland) GmbH for the agreed duration of the contract, for parking purposes only. Monitoring and safekeeping shall not form part of the object of the contract. Customers shall not have a claim to a particular parking bay. Furthermore, the agreed service shall include the transfer of the vehicle from the airport to the parking bays and back. The relevant arrival and departure times must be indicated by the customer within the framework of the reservation. The customer must inform Airportparking (Switzerland) GmbH of subsequent changes to the transfer times no later than 12 hours prior to the times. The customer shall be obliged to inform Airportparking (Switzerland) GmbH in good time of cancellations, changes in reservations, flight number changes and significant delays in the return flight. The customer shall ensure that he arrives at the terminal in time. Where the customer is not able to undertake the flight and where the customer vehicle has already been removed by Airportparking (Switzerland) GmbH, an administration fee of CHF 50.00 shall apply. Airportparking (Switzerland) GmbH shall consequently not be liable for possible late arrivals by the customer at the airport. Due to transfers of the vehicles, it may occur that a maximum of 20 kilometres may have to be covered with the vehicle.

III. Prices and conditions of payment
The prices indicated by Airportparking (Switzerland) GmbH shall in principle be binding. The price stipulated in the reservation and confirmed by Airportparking (Switzerland) GmbH within the framework of the reservation confirmation shall be decisive. In all cases, the prices stipulated shall include the relevant statutory VAT as amended. The agreed parking fee shall be due at the latest at the agreed return date of the vehicle and shall be paid by the customer. Where the agreed parking duration is exceeded, the relevant applicable tariff shall be additionally calculated. Each started day shall be calculated as a full day. Reservations effected at the counter shall be subject to an Express surcharge of CHF 15.00.

IV. Cancellations, changes in reservations and subsequent changes to booked services
Booked services may be cancelled prior to start of the parking period at no charge. Cancellations must be made with Airportparking (Switzerland) GmbH either in writing or telephonically. Decisive point in time of the cancellation shall be receipt of the declaration at Airportparking (Switzerland) GmbH. Notification of changes in reservations (earlier or later return journey) during travel must be made telephonically to +41 43 816 32 62 (7:00 – 22:00) or by email to schalter@airportparking.ch. This notification must occur no later than 12 hours prior to landing in Zürich. We shall accept no liability for changes we have not received notification on, and waiting periods of indefinite duration must be anticipated for the vehicle to be available. In addition, a fee of CHF 50.00 shall be levied for changes that have not been reported.

V. Liability
Liability on the part of Airportparking (Switzerland) GmbH as well as of a legal representative or vicarious agent shall in principle be excluded. Liability for damages due to life, limb or health as well as for other damages due to wilful or grossly negligent violation of obligations by Airportparking (Switzerland) GmbH, a legal representative or vicarious agent shall be excluded. Airportparking (Switzerland) GmbH shall not be liable for damages incurred to vehicles parked in the bays or for theft from these vehicles. Likewise, Airportparking (Switzerland) GmbH shall not be liable for vehicles stolen from the parking bays. In the event that a vehicle does not start due to a technical defect, it shall be the responsibility of the customer to take the relevant measures (TCS – Touring-Club der Schweiz – Swiss Touring Club). In the event that the vehicle still does not start after intervention by the TCS, Airportparking (Switzerland) GmbH shall not be liable for any return trip or overnight accommodation costs (taxi, rental car, hotel). Liability shall not be accepted for technical or mechanical defects in a vehicle after handing over the vehicle or prior to collecting the vehicle. Any repairs shall be the responsibility of the customer. Vehicles that do not start due to a drained or weak battery shall be jump-started by us, however without guarantee for subsequent functionality. A subsequent exchange of battery shall be excluded and rejected. In the event of the loss of a key on the part of Airportparking (Switzerland) GmbH, a vehicle shall be made available to the customer for his journey home, the spare key collected from the customer within a reasonable period of time and the customer vehicle driven to the customer. Airportparking (Switzerland) GmbH shall assume the costs for a spare key; replacement of the ignition lock and the door lock shall be excluded. Where damages to customer vehicles are caused and reported by Airportparking (Switzerland) GmbH employees (excluding corrosion damage, technical defects, parking damages, force majeure, vandalism etc.), the amount stipulated by the insurance company shall be paid out to the customer. Additional claims on the part of the customer, such as replacement vehicle, loss of bonus, administration fees and all other claims not covered by the insurance of Airportparking (Switzerland) GmbH shall be excluded.

VI. Data protection
Airportparking (Switzerland) GmbH guarantees that all personal data of the customer entered in the reservation form shall not be passed on to third parties and that the data shall be exclusively used for fulfilment of the service required by you.
